Appealing Child Protective Services Findings

At the end of every investigation, a determination is made as to whether the reported abuse or neglect is “indicated”, “unsubstantiated” or “ruled out.” Anyone believed responsible for “indicated” or “unsubstantiated” child abuse or neglect is entered into a confidential state database that include the names of all individuals provided a service by a local department and may be eligible for a hearing at the Office of Administrative Hearings. To determine eligibility for such a hearing, DHR needs your notarized permission to search its database and locate any investigative files. If you complete return the Child Protective Services Background Clearance form to DHR, we will notify you as whether you are entitled to a hearing.

We cannot accept forms that are incomplete or not notarized.
